By using this website and/or making a booking through this platform or via our WhatsApp number, you acknowledge and agree to all terms and conditions stated herein. This website is operated by a third-party booking partner and is not owned, managed, or operated by the cruise service provider. We act solely as an intermediary booking platform.

1. Definitions & Scope

"Platform" refers to the website calmadinnercruise.in and the WhatsApp booking service operated through the number +91 9817363968.

"We," "Us," "Our" refers to the third-party booking partner operating this Platform. We are an independent entity acting solely as an intermediary to facilitate bookings between customers and the cruise service provider.

"Cruise Service Provider" refers to the entity that owns, operates, and manages the actual dinner cruise vessel, food, beverages, entertainment, transportation (including pickup and drop services), and all on-board and off-board experiences.

"Customer," "You," "Your" refers to any individual or group making a booking through this Platform.

"Booking" refers to the reservation of seats on the dinner cruise made through this Platform, subject to availability and confirmation.

"Services" refers to all services provided in connection with the cruise, including but not limited to the cruise experience, food and beverages, entertainment, pickup and drop-off transportation, and any other amenities offered by the Cruise Service Provider.

2. Our Role as Booking Partner

This Platform is owned and operated by an independent third-party booking company. We are not the cruise operator, service provider, or owner of any vessel, food service, beverage service, entertainment, or transportation service associated with the dinner cruise.

Our role is strictly limited to:

  • Facilitating the booking and reservation of cruise seats on behalf of customers.
  • Collecting payments on behalf of the Cruise Service Provider.
  • Communicating booking confirmations, cancellations, and related information.
  • Providing customer support for booking-related queries through this website and the WhatsApp number +91 9817363968.

We do not provide, manage, control, or operate any of the following:

  • The dinner cruise vessel or any watercraft.
  • Food, beverages, and dining services aboard the cruise.
  • Entertainment, music, or any on-board activities.
  • Pickup and drop-off transportation services.
  • Safety equipment, crew, or personnel on the cruise.
  • Any amenities, decorations, or special arrangements during the cruise.

All such Services are exclusively provided by the Cruise Service Provider, and the customer's contract for such Services is directly with the Cruise Service Provider.

3. Booking Terms & Conditions

3.1 Availability: All bookings are subject to availability. A booking request does not guarantee confirmation until expressly confirmed by the Platform or the Cruise Service Provider.

3.2 Confirmation: A booking is considered confirmed only after: (a) successful payment has been processed, and (b) a confirmation message has been sent to the customer via WhatsApp or email. All bookings require administrative approval before final confirmation.

3.3 Seat Reservation: During the payment process, seats are temporarily reserved for a period of 15 minutes. If payment is not completed within this time, the reservation is automatically released and the seats may be allocated to other customers.

3.4 Accuracy of Information: The customer is solely responsible for providing accurate and complete information at the time of booking, including but not limited to name, phone number, number of guests, date selection, and transportation preferences. We are not liable for any issues arising from incorrect information provided by the customer.

3.5 Booking Modifications: Modifications to an existing booking (such as change of date, number of guests, or transportation preference) are subject to availability and must be requested at least 24 hours prior to the scheduled cruise. We reserve the right to charge a modification fee or decline the request based on availability.

3.6 No Transferability: Bookings are non-transferable and cannot be resold, gifted, or assigned to another person without prior written consent from Us.

3.7 Children & Infants: Children aged 5–10 are charged at a reduced rate as displayed at the time of booking. Infants below 5 years of age are permitted free of charge. The customer must accurately declare the number and ages of all children at the time of booking.

4. Payment Terms

4.1 Payment Methods: All payments are processed securely through Razorpay, a certified PCI-DSS compliant payment gateway. We accept UPI, credit cards, debit cards, net banking, and digital wallets.

4.2 Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice. The price displayed at the time of booking confirmation shall apply to your booking.

4.3 Payment Options: The Platform may offer the following payment options, subject to availability:

  • Full Payment: The entire booking amount is paid online at the time of booking.
  • 10% Advance Payment: A 10% advance is paid online, with the remaining balance payable at the venue before boarding.
  • Pay at Jetty: No online payment is required; the full amount is payable in cash or digital payment at the boarding point before the cruise.

4.4 Failed Payments: If a payment fails or is declined, the booking will not be confirmed. Payment gateway charges, if any, deducted during a failed transaction are not the responsibility of the Platform and will be refunded as per the payment gateway's policies.

4.5 Advance Payment Balance: If you selected the 10% advance option, the remaining balance must be paid at the venue before boarding. Failure to pay the balance amount may result in denial of boarding without any refund of the advance amount.

5. Cancellation Policy

5.1 Customer-Initiated Cancellation: Cancellations made 24 hours or more before the scheduled cruise departure time are eligible for a full refund. Cancellations made less than 24 hours before departure may be subject to a cancellation fee of up to 50% of the booking amount.

5.2 No-Show Policy: Customers who fail to arrive at the boarding point at the scheduled time ("no-show") will not be entitled to any refund, rescheduling, or compensation.

5.3 Operator-Initiated Cancellation: The Cruise Service Provider reserves the right to cancel or postpone any cruise due to adverse weather conditions, government orders, safety concerns, mechanical issues, or insufficient passenger count. In such cases, customers will be offered either a full refund or complimentary rescheduling.

5.4 Force Majeure: Neither the Platform nor the Cruise Service Provider shall be liable for cancellations, delays, or non-performance caused by circumstances beyond reasonable control, including but not limited to natural disasters, epidemics, pandemics, government restrictions, civil unrest, strikes, or acts of God.

6. Limitation of Liability & Disclaimers

6.1 No Liability for Services: As a third-party booking partner, We are NOT liable, responsible, or accountable for any aspect of the cruise experience, including but not limited to:

  • Quality, safety, or condition of the cruise vessel.
  • Quality, quantity, hygiene, or taste of food and beverages served on the cruise.
  • Quality or content of entertainment, music, or activities provided during the cruise.
  • Quality, timeliness, safety, or reliability of pickup and drop-off transportation services.
  • Delays, cancellations, or changes to the cruise schedule by the Cruise Service Provider.
  • Behavior, conduct, or competency of the crew, drivers, or any personnel of the Cruise Service Provider.
  • Any decorations, special arrangements, cakes, or other add-on services provided by the Cruise Service Provider.

6.2 No Liability for Damage or Loss: We shall NOT be held liable for any personal injury, bodily harm, death, loss of property, damage to belongings, theft, or any other loss or damage sustained by the customer or any member of the customer's party during the cruise, transportation, or any related activity. Any claims for such losses must be directed to the Cruise Service Provider.

6.3 No Warranty: We make no warranties, representations, or guarantees, express or implied, regarding the quality, standard, safety, or suitability of the cruise experience. All Services are provided by the Cruise Service Provider "as is" and "as available."

6.4 Assumption of Risk: By making a booking, the customer acknowledges and accepts all inherent risks associated with water-based activities, including but not limited to risks of drowning, motion sickness, weather-related hazards, and marine emergencies. The customer voluntarily assumes all such risks.

6.5 Indemnification: The customer agrees to indemnify, defend, and hold harmless the Platform, its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to the customer's use of the Services, violation of these Terms, or any acts or omissions during the cruise.

6.6 Maximum Liability: In any event, Our maximum aggregate liability for any claim arising out of or related to the booking shall not exceed the amount paid by the customer for that specific booking.

7. Safety & Conduct

7.1 Safety Compliance: All guests must comply with safety instructions provided by the cruise crew at all times. Failure to follow safety instructions may result in removal from the cruise without refund.

7.2 Appropriate Behavior: Guests engaging in disruptive, violent, or inappropriate behavior may be removed from the cruise at the discretion of the crew. No refund shall be provided in such cases.

7.3 Intoxication: Guests who are excessively intoxicated may be denied boarding or removed from the cruise. The decision of the crew in this regard is final.

7.4 Health Declaration: Customers are advised to disclose any medical conditions, physical disabilities, or health concerns that may affect their ability to safely participate in the cruise. The Platform and the Cruise Service Provider are not responsible for medical emergencies arising from undisclosed conditions.

7.5 ID Proof: Guests may be required to carry a valid government-issued photo ID for verification purposes at the boarding point.

8. Intellectual Property

All content on this Platform, including but not limited to text, graphics, logos, images, software, and design, is the property of the Platform and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or use of any content from this Platform is strictly prohibited.

9. Data Privacy & Communication

By making a booking, you consent to receiving communications via WhatsApp, SMS, and email regarding your booking status, confirmations, cancellations, and promotional offers. You may opt out of promotional communications at any time. For details on how we handle your data, please refer to our Privacy Policy.

10. Governing Law & Dispute Resolution

10.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

10.2 Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Goa, India.

10.3 Arbitration: Before resorting to litigation, the parties agree to first attempt to resolve any dispute through good-faith negotiation and, if necessary, through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

11. Amendments & Severability

11.1 We reserve the right to update, modify, or amend these Terms & Conditions at any time without prior notice. The latest version will always be available on this page. Continued use of the Platform after any changes constitutes acceptance of the updated Terms.

11.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
